This Legal Notice regulates the conditions of access, navigation and use of the website hocelot.com (hereinafter, the "Website"), through which Hocelot, owner thereof, presents to users information about the content and modalities of provision of the services it offers.

Hocelot Financial Technologies, S.L. is a company with CIF B-87546164, registered office at Calle Alfonso XII nº 10, 2 left, CP 28014, Madrid, and registered in the Commercial Registry of Madrid, at Volume 34626, folio 10, sheet M-622956 (hereinafter, "Hocelot") with which you can communicate through telephone 91 064 94 18, or by sending an email to info@hocelot.com.

Hocelot understands that by accessing, navigating or using the Website, you accept without reservation all the conditions set forth in this Legal Notice. Please read it carefully.

2. Your use of the Website

You undertake to make appropriate use of all the contents, services, applications and tools accessible on the Website, in accordance with applicable regulations and this Legal Notice.

By accessing, navigating or using the Website, you undertake not to make any illicit, illegal use, contrary to good faith, morals and public order, or unauthorized use thereof, and in particular, you expressly undertake, without this list being limiting, to:

  • Not perform any action intended to harm, block, damage, disable, overload, whether temporarily or permanently, the functionalities, tools, contents and/or infrastructure of the Website, nor to prevent in any way its normal operation;

If necessary for access to certain Website tools, provide truthful, updated and accurate information through the registration forms enabled by Hocelot.

In case of total or partial breach of these conditions of use on your part, Hocelot may deny you access to the Website without prior notice, in addition to adopting the measures it deems appropriate in accordance with applicable legislation. Likewise, you will be liable for all damages and harm, of any nature, that Hocelot or any third party may suffer as a consequence of said breach.

3. Responsibilities and warranties

Hocelot does not guarantee nor is it responsible for continued access, correct visualization, operation and/or usefulness of the Website contents; the veracity and/or reliability of the Website contents; and the absence of viruses or other harmful or damaging programs on the Website or that may be transmitted through it, without it being possible to demand any compensation for these causes.

In any case, Hocelot has adopted adequate security measures, within its possibilities, to avoid any of the aforementioned eventualities and guarantee the correct operation and security of the Website.

In particular, and without this list being limiting, Hocelot assumes no responsibility for damages, harm, losses, claims or expenses caused by:

  • Interference, interruptions, failures, omissions, delays, blockages or disconnections, caused by errors in telecommunications lines and networks or by any other cause beyond Hocelot's control.
  • Illegitimate intrusions through the use of malicious programs of any type and through any means of communication, such as computer viruses or any others.
  • Improper or inadequate use of the Website.
  • Security or navigation errors caused by malfunction of the browser or by the use of non-updated versions.

Likewise, Hocelot is not responsible nor will it respond in any case to users and/or third parties for acts of users or third parties that suppose or may suppose the performance of illicit acts or contrary to current legislation committed through the transmission, dissemination, storage, making available, reception, obtaining or access to the contents of the Website, and within the framework of applicable legislation.

If you become aware of the performance through the Website of any illicit act or contrary to applicable legislation, or that could constitute an infringement of any third party right, you must immediately inform Hocelot through telephone 91 064 94 18, or through sending an email to info@hocelot.com, so that Hocelot can adopt as quickly as possible the appropriate measures against said act.

4. Intellectual and industrial property

The Website, the pages it comprises, as well as its contents (including texts, documents, photographs, drawings and graphic representations, among others), are protected by intellectual and/or industrial property rights, owned by Hocelot or third parties.

You have a private use right over the contents of the Website only to be able to use it, diligently and correctly and in any case in accordance with the conditions established in this Legal Notice. In no case shall it be understood that there is a waiver, license, transmission or assignment of any intellectual and/or industrial property rights in your favor, or in favor of a third party, by the mere fact of accessing, navigating or using the Website.

You are not authorized to proceed with the distribution, modification, transformation, copying, reproduction, assignment or public communication and any other forms of exploitation, of part or all of the contents of the Website, in any way and regardless of its purpose, without express, written and prior authorization from Hocelot or from the third parties who own the rights that protect said contents.

Links to sites or pages and/or third-party websites eventually present on the Website have been established solely as a utility for the User, with an exclusively informative purpose and, in no case, imply support, approval, marketing or any relationship between Hocelot and the persons or entities that own said pages and/or websites.

Hocelot is not responsible for the operation and/or content of said third-party pages and/or websites.

On the other hand, to establish links with any of the pages of the Website, prior, express and written authorization from Hocelot will be necessary.

6. Protection of your personal data

In accordance with current legislation, you are duly informed that your personal data may be processed by Hocelot, as Data Controller for the purposes of: (i) providing you with information of interest about our services and/or resolving any doubt or incident you may have (ii) managing a possible commercial relationship that links you with Hocelot; (iii) Managing your candidacy in a selection process; and (iv) knowing the use made of Hocelot's Website and thus improving its performance, as well as conducting statistical studies on Hocelot's commercial activity. The legal bases that support the aforementioned data processing are: (i) your express consent; (ii) Hocelot's legitimate interest; and (ii) the execution of pre-contractual measures at the request of the interested party. In case of discrepancy between the general conditions established in this Legal Notice and the particular conditions that, where appropriate, Hocelot may establish for the use of certain applications and/or utilities of the Website, the latter will prevail.

The non-exercise or execution by Hocelot of any right or provision contained in this Legal Notice will not constitute a waiver thereof, except express and written acknowledgment on its part.

This Legal Notice and its terms and conditions will be governed and interpreted in accordance with Spanish Law. The Courts of Madrid will be competent to hear any controversy and/or litigation arising from or related to the conditions contained in this Legal Notice, and/or with access, navigation or use of the Website, with both Hocelot and the user of the Website renouncing any other jurisdiction that may correspond to them.

However, if you use the Website as a Consumer, as defined in article 3 of Royal Legislative Decree 1/2007, of November 16 (General Law for the Defense of Consumers and Users), we inform you that any controversy that arises with the use of the Website will be submitted to the jurisdiction of the courts and tribunals of your domicile.
